1) Acceptance of Terms

By accessing or using the My Genealogy Hub website (the “Platform”), you (“User”) agree to be legally bound by these Terms & Conditions (the “Terms”). If you do not agree to these Terms, you must not use the Platform.

Use of the Platform constitutes full acceptance of these Terms without modification.

2) Definitions

For the purposes of these Terms:

Platform: The My Genealogy Hub website (mygenhub.com), its content, functionality, and administrative operations.
User: Any individual or entity accessing, browsing, or using the Platform for any purpose, including Clients and Genealogists.
Client: Any User seeking genealogy-related services through, or connected by, the Platform.
Genealogist: Any individual or entity listed on the Platform, whose information is displayed for referral and connection purposes.
Referral: Any introduction, forward, or transmission of client information or inquiry made by the Platform to a Genealogist.
Middleman Service: An optional service whereby the Platform temporarily holds funds until project completion, if chosen by the Client.
Operator: The individual currently operating the Platform, until such time that an incorporated legal entity assumes operation.

3) Nature of the Platform

3.1 Directory and Referral Service Only.
The Platform is an online directory and referral service facilitating connections between Clients and independent Genealogists. The Platform does not provide genealogy services, research, analysis, document retrieval, translation, certification, or any related professional services.

3.2 No Employment or Agency Relationship.
Genealogists listed on the Platform are independent third parties. The Platform does not employ, manage, supervise, or control Genealogists and does not guarantee the availability, skill, or performance of any Genealogist.

3.3 No Contract Formation With the Platform.
Any agreements, payments, instructions, project scopes, deadlines, or communications relating to genealogy services occur exclusively between the Client and the Genealogist.
The Platform is not a party to, and bears no responsibility for, such contractual relationships.

4) Availability and Accuracy of Information

4.1 User-Supplied Information.
Genealogist profiles, descriptions, photographs, pricing, specialties, and all related information are provided directly by the Genealogists. The Platform does not guarantee the accuracy, reliability, completeness, or timeliness of such information.

4.2 No Guarantee of Results.
The Platform does not warrant or represent that the use of the Platform will result in a successful connection, project, genealogy discovery, or desired outcome.

4.3 Website Availability.
The Platform is provided on an “as-is” and “as-available” basis. The Operator makes no guarantees regarding uptime, availability, or uninterrupted access.

5) User Eligibility (18+)

5.1 Age Requirement.
The Platform is intended for individuals 18 years of age or older.
By using the Platform, the User represents and warrants that they are at least 18 years old and have the legal capacity to enter contractual relationships.

5.2 Minors.
If you are below 18 years of age, you must not use the Platform under any circumstances.

6) Permitted and Prohibited Use

6.1 Permitted Use.
Users may access the Platform to browse genealogist profiles, read articles, submit inquiries.

6.2 Prohibited Actions.
Users must not, under any circumstances:

Submit spam, automated messages, or abusive content.
Misuse contact forms for non-genuine inquiries.
Upload, transmit, or publish illegal, fraudulent, defamatory, or harmful content.
Impersonate any person or entity.
Leave false, misleading, or malicious reviews.
Scrape, harvest, extract, or reproduce Platform data without authorization.
Attempt to breach security mechanisms, disrupt operations, or interfere with Platform functionality.
Use the Platform for unlawful or inappropriate purposes.

Violation of this clause may result in immediate access restriction, account blocking, or legal action.

7) Responsibilities of Genealogists

Genealogists listed on the Platform agree to:

Provide accurate and truthful information for their profile.
Update the Platform regarding changes to their details.
Offer lawful, ethical, and professional services to Clients.
Avoid fraudulent, misleading, or illegal activity.
Not exploit or misuse Clients or the Platform.
Not submit or encourage fake reviews.
Comply with any applicable laws in their jurisdiction.
Genealogists agree to pay the Platform a referral fee on the total amount received from each Client referred by the Platform.

Genealogists bear full responsibility for all services they provide and for their interactions with Clients.

8) Referral Fees and Middleman Services

8.1 Referral Fees (General Public Notice).
Users are hereby informed that the Platform may receive a referral fee from Genealogists for successful referrals.
The exact commercial terms governing referral fees are set forth in separate agreements between the Platform and Genealogists and are not part of these public Terms.

8.2 Middleman Services.
Clients may request optional middleman services. Such services, if elected, involve payment handling by the Platform until project completion.
Use of middleman services is voluntary and subject to separate terms communicated at the time of use.

9) No Liability for Third-Party Services

9.1 Independent Contractors.
All genealogy services are performed exclusively by independent Genealogists, not by the Platform.

9.2 No Warranty or Responsibility.
To the fullest extent permitted by law, the Platform disclaims all liability for:

the quality, accuracy, or outcomes of genealogy services;
delays, communication failures, or non-performance by Genealogists;
any financial disputes between Clients and Genealogists;
damages, losses, or issues arising from external websites, archives, or third-party services;
reliance on genealogy research, documents, or results provided by Genealogists.

The Client engages the Genealogist at their own risk.

10) Intellectual Property

10.1 Platform Content.
All copyright, trademarks, design elements, layout, and written content originating from the Platform are owned by the Operator.

10.2 Genealogist Content.
Genealogists retain rights to the photos, texts, documents, and portfolios they submit. The Platform is granted a non-exclusive right to display such content while the profile remains active.

10.3 Restrictions.
Users must not copy, reproduce, redistribute, or publish Platform content without prior written authorization.

11) External Links

The Platform may contain links to archives, databases, or third-party websites.
The Platform does not control, endorse, or assume responsibility for external sites or their content.

12) Suspension and Termination

The Platform may, at its sole discretion, suspend or permanently remove any User or Genealogist who:

violates these Terms;
engages in fraudulent or illegal behavior;
abuses or misuses the Platform;
submits false or misleading information;
fails to comply with applicable agreements; or
poses risk to Clients or to Platform integrity.

13) Modifications to Terms

The Platform may modify or update these Terms at any time.
Revised Terms will be posted on this page with a new “Last Updated” date. Continued use of the Platform constitutes acceptance of any revisions.

14) Governing Law

These Terms are governed by the laws applicable in the Operator’s country of residence, without regard to conflicts of law principles.
The Operator may update this clause once an incorporated entity assumes operation of the Platform.
